ECCLESTON YARDS MURAL COMPETITION - TERMS AND CONDITIONS (OFFICIAL RULES)

DO NOT ENTER IF YOU ARE NOT ELIGIBLE. BY SUBMITTING YOU ARE AGREEING TO BE BOUND BY THESE OFFICIAL RULES AND ARE CONFIRMING THAT YOU ARE ELIGIBLE TO ENTER. IF YOU ARE ENTERING ON BEHALF OF A MINOR UNDER THE AGE OF 18, BY SUBMITTING YOU ARE AGREEING TO BE BOUND BY THESE OFFICIAL RULES IN YOUR CAPACITY AS A PARENT / GUARDIAN OF THAT MINOR AND YOU CONFIRM THAT THE ELIGABILITY REQUIREMENTS HAVE BEEN MET.
PARENTS / GUARDIANS SHALL ENTER ON BEHALF OF ANY ARTISTS UNDER THE AGE OF 18 WHO WISH TO SUBMIT AN ARTWORK. IF AN ARTIST UNDER THE AGE OF 18 WINS THEY MUST BE ACCOMPANIED BY THE PARENT/GUARDIAN WHO ENTERED ON THEIR BEHALF UNLESS AGREED OTHERWISE BY THE SPONSOR.

  1. SPONSOR

Grosvenor Estate Management Limited (company number 02048534), 70 Grosvenor Street, London, W1K 3JP (the Sponsor)

  1. ELIGIBILITY

Open to individuals of any age who are UK resident as of the date of registration. The parent or legal guardian of the minor in their jurisdiction of residence must enter on their behalf. The Sponsor may ask entrants and artists to provide proof of age. Employees, officers and directors (or any children of such persons) of the Sponsor and its parent companies, subsidiaries, and affiliated companies, are not eligible to enter. No purchase or payment of any kind is necessary to enter or win.
By participating, entrants agree to these Official Rules and decisions of the Sponsor are final and binding in all respects. Void where prohibited or restricted by law. Subject to all applicable laws and regulations.

  1. COMPETITION TIMING

The Competition begins on Friday 17th April 2020 at 0001 BST and ends 05 June 2020 at 2359 BST (the Competition Period). The Sponsor’s computer is the official timekeeping device for the Competition Period. All entries must be received by the Sponsor no later than the end of the Competition Period. Any entries received after the Competition Period ends will be automatically disqualified. The Sponsor reserves the right to extend the Competition Period in its sole and absolute discretion.

  1. COMPETITION ASSIGNMENT

The Competition invites the entrant to submit a piece of their own (or in the case of a parent or guardian, a minor's) artwork, either drawn or painted by hand, with their thank you message to the NHS. This should be on plain paper which can be photographed or scanned and uploaded. The artwork can include words if desired and should be in colour.

  1. THE PRIZE

The winning entry will be re-created onto the mural site within the Eccleston Yards courtyard and the winner will receive a cash prize of £500 (this will be paid to the entrant if 18 or over or to the parent / guardian of an artist under 18). The winner plus one person will also be invited to a day out at Eccleston Yards which will include a meal and two activities offered by businesses operating at Eccleston Yards, to be agreed with the winner (or if these cannot be agreed, as determined by the Sponsor in its sole discretion), up to a value of £250. The mural will be guaranteed to stay in situ for a minimum of 12 months. The winner shall be named as either the entrant if they are 18 or over or the artist who created the art that is subsequently submitted by their parent / guardian. The prize is non-transferable. Reasonable and documented travel expenses to and from those destinations listed above are included in the prize but any additional expenses are the responsibility of the entrant.

  1. HOW TO ENTER

To enter the Competition visit ecclestonyards.com (the Website) then, follow the online instructions to register your details and then upload and submit your entry before the end of the Competition Period.
An entrant may make as many submissions as they please.
Format for submissions
Submissions should be drawn or painted by hand on plain paper and be able to be photographed or scanned and uploaded. The artwork can include words if desired and should be in colour.
Watermarks are allowed but not encouraged.
The original artwork should be retained in case the Sponsor needs to take a high quality scan of the winning submission for the purposes of producing the mural. Failure to produce the original artwork when requested may result in disqualification in the Sponsor's sole discretion.
Content Restrictions
The content of the submission must comply with these Official Rules.
In its sole and absolute discretion, the Sponsor may reject any submission that (a) includes material or subject matter that is inappropriate, obscene, sexually explicit, politically sensitive, defamatory, disparaging, unlawful, offensive, false or misleading; (b) depicts or promotes the consumption of alcohol, tobacco, illegal drugs, or the use of firearms or weapons; or (c) includes personally identifying information or similarly defined personal information in applicable privacy legislation (PII) of any kind (this includes an image of an identifiable person), other than in circumstances where the entrant has obtained explicit consent from the individual to whom the PII relates. If the entrant cannot provide evidence that the individual has given such consent, the entry may be disqualified.
The submission must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, trademark rights, image rights or that constitutes copyright infringement or which otherwise is in violation of any applicable law which the entrant is subject to in his/her jurisdiction.
Entrants agree to not post, e-mail or otherwise submit anything that knowingly contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
The Sponsor reserves the right, in its sole and absolute discretion, to remove any entry and disqualify you from the Competition if it believes that the entry fails to conform to the above Content Restrictions and/or any restrictions set forth in the Official Rules or if you provide false information in entering the Competition, or if your conduct is contrary to the spirit or intention of the Competition.
Receipt of entry will not be acknowledged or returned. Proof of submission will not be deemed to be proof of receipt by the Sponsor. The Sponsor does not accept responsibility for any entries including for equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
BY SUBMITTING AN ENTRY, THE ENTRANT ACKNOWLEDGES (WITHOUT PREJUDICE TO THE LICENCE SET OUT BELOW) THAT HIS/HER SUBMISSION MAY BE POSTED (IN THE SPONSOR'S SOLE AND ABSOLUTE DISCRETION) ON THE WEBSITE OR SOCIAL MEDIA FEEDS, IN WHOLE OR IN PART AND MAY BE REPRODUCED AS A MURAL AT ECCLESTON YARDS.

  1. OWNERSHIP OF ENTRIES AND INTELLECTUAL PROPERTY

By entering, each entrant warrants and represents the following with respect to their submission: (a) entrant is the sole and exclusive owner of the idea in submission; (b) the submission is entrant’s own creation and is 100% original; (c) publication of the idea will not breach any rights of any third parties; and (d) submissions are in accordance with these Official Rules. If a parent / guardian is entering on behalf of minor under the age of 18, these warranties and representations are made on behalf of the minor by the parent / guardian. Each entrant indemnifies and holds harmless the Sponsor and Releases the Sponsor (in accordance with the “Limitation of Liability” section below) from any claims to the contrary (to the extent permitted by law).
The Sponsor does not claim any rights of ownership in your entry.
You agree that the Sponsor may, but is not required to, make your entry available on its websites (including mayfairandbelgravia.com, ecclestonyards.com or grosvenor.com) and any other media, whether now known or invented in the future and has the right to post, publish, and otherwise make use of, entrant's name, location,  biographical information, submission summary and any imagery submitted in publication and/or on the internet, for advertising and/ or promotional use in any media in connection with and/or related to the Competition without notice or compensation of any kind.
You grant the Sponsor a non-exclusive, worldwide, royalty-free, irrevocable licence, for the full period of any intellectual property rights in the entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the entry and any accompanying materials.
Copyright in all entries remains the property of the entrant at all times; however, in addition to the above licence, entrants agree to the maximum extent permitted by law, to waive all or not to assert any of their moral rights in the ideas and images submitted (or equivalent rights anywhere in the world) as against the Sponsor and its agents, affiliates and subsidiaries in particular but without limitation the right to be referenced as the owner of the idea/image or to modify in any way the submitted idea/images to the extent permitted by law.

  1. LIMITATION OF LIABILITY

Insofar as is permitted by law, the Sponsor, its parent companies, subsidiaries and affiliated companies and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (individually and collectively Releasees ) will not in any circumstances be responsible or liable to compensate any entrant or accept any liability for any loss or damage of any kind, personal injury or death occurring as a result of entering the Competition. Such loss includes but is not limited to any losses or damage or violation of intellectual property or personal rights (such as but not limited to, copyright, trade name/trademark, and/or rights of privacy or publicity or portrayal in a false light).

  1. GENERAL/MISCELLANEOUS

ENTRIES SUBMITTED ARE THE IDEAS/VIEWS/ OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER.
Any waiver or non-use of any rights hereunder by the Sponsor does not constitute a general waiver of any other Sponsor rights. Releasees not responsible for lost, late, misdirected, incomplete, or non-received submissions or e-mail, for any reason whatsoever. Any persons who engage in unlawful activities in connection with the operation of the Competition, as solely determined by the Sponsor, will be disqualified. Any entrant not complying with the conditions of participation or with the Official Rules may be disqualified from the competition.
Releasees are not responsible for injury or damage to entrants or to any other person’s computer related to or resulting from participating in this Competition or downloading materials from or use of the Website.
Should any portion of the Competition be, in the Sponsor’s sole opinion, compromised by technical or other failures, the Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Competition, and proceed only with any submissions received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.
The Sponsor is under no obligation to proceed with all or any of the entries.
In case of dispute, the authorised account subscriber of the e-mail account used to enter the Competition at the actual time of entry will be deemed to be the entrant and must comply with these Official Rules.
All age restrictions are applied as at the date of an entry being submitted. For the avoidance of doubt, if a parent or guardian enters the Competition on behalf of a minor under the age of 18, that parent or guardian is responsible for the legal obligations and responsibilities created by these Official Rules.
If any provision(s) of these Official Rules (or any part thereof) are held to be invalid or unenforceable, all remaining provisions (or any part thereof) hereof will remain in full force and effect.

  1. CHOICE OF LAW AND JURISDICTION

These Official Rules and the Competition shall be governed by, and construed in accordance with, English law. The courts of England shall have the exclusive jurisdiction to settle any dispute that may arise out of, under, or in connection with the Competition, these Official Rules, or the legal relationship established by them.

  1. USE OF DATA

The Sponsor will collect personal data about entrants online for the administration of the Competition, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at https://www.grosvenor.com/legal/privacy-notice. Entrants also agree that the information and submission they have provided to the Sponsor may also be used for any reasonable and related promotional purposes.
By entering the Competition, you agree that any personal information provided by you with your entry may be held and used by the Sponsor or its agents and suppliers to administer this Competition.

  1. CHANGES TO THE OFFICIAL RULES

The Sponsor reserves the right to hold void, suspend, cancel or amend the Competition where it becomes necessary to do so.
Sponsor reserves the right, at its discretion, to make changes to any part of these Official Rules. Due to its policy of updating and improving these Official Rules, Sponsor may wish to change these Official Rules. If an entrant uses this Website or chooses to participate in this Competition after Sponsor has published or notified entrant of the changes, entrants are agreeing now to be bound by those changes. If an entrant does not agree to be bound by those changes, an entrant should not use the Website or participate in the Competition.
